DE State-licensed online casinos

Online casinos in Delaware

Online casinos in Delaware are legal and run by the state itself: the Delaware Lottery operates online games for the state's three casinos, Delaware Park, Bally's Dover and Harrington, on a platform powered by BetRivers. Anything else, including offshore casinos, is unauthorized in the state's view. Here's how the system works and what it means for players.

Are online casinos legal in Delaware?

Yes. The Delaware Gaming Competitiveness Act of 2012 authorized online casino games, and the state chose to run them through its own Lottery rather than license private operators. Today the Delaware Lottery's iGaming page (opens in a new tab) describes online games offered by Delaware Park, Bally's Dover and Harrington, all on a platform powered by BetRivers.

That makes Delaware one of seven states with legal online casinos, with New Jersey, Pennsylvania, Michigan, West Virginia, Connecticut and Rhode Island. It is also the most centralized: one state agency, one technology platform and three casino brands. The official pages we relied on don't give a launch date, so we don't quote one.

The minimum age is 21 for online casino games, casino floors and sports betting. The full legal framework, including how the Lottery and the Division of Gaming Enforcement split their roles, is on our Delaware gambling laws page.

How Delaware's Lottery-run online casino system works

In most licensing states, a regulator issues licenses and private companies compete. Delaware works differently. The Delaware Lottery sits at the center, offering online casino play on behalf of the three casinos, while the Division of Gaming Enforcement (opens in a new tab) handles enforcement work across the gaming industry.

CasinoOnline casino gamesSportsbookOnline platform
Delaware ParkYes, through the Delaware LotteryYesBetRivers-powered
Bally's DoverYes, through the Delaware LotteryYesBetRivers-powered
HarringtonYes, through the Delaware LotteryYesBetRivers-powered

For players, that structure means a small, tightly controlled menu: the same platform behind each casino's online brand, state oversight of every game and payment, and a state agency answerable for complaints. Compare that with the protections explained in player protections at offshore vs licensed casinos.

Why the small market matters

With its largest city home to about 73,500 people, Delaware's online casino market was never going to support dozens of brands. The state's answer was to pool the three casinos on one system. That limits choice, which is the main reason some Delaware residents look further afield, and why it's worth knowing exactly how offshore sites differ.

What Delaware says about offshore and unlicensed casino sites

Delaware officials have stated their position plainly. In an April 7, 2025 state news release (opens in a new tab) on shutting down illegal online slots, they said real money games offered by unlicensed entities violate the Delaware Constitution, the Delaware Penal Code and the Delaware Gaming Competitiveness Act of 2012, and that residents should play only at authorized Delaware casinos, which can be verified through the Lottery.

Offshore casinos, including those whose offers appear on this page, are not authorized in Delaware. Their licenses, where they name one at all, come from places such as Anjouan, and third-party reviewers report others in Curaçao or Costa Rica, or none. None of that is a Delaware or US state license. Our explainer on offshore casino legality covers how federal and state law interact.

We report what Delaware's officials say; we don't predict what happens to any individual player. If you want the general answer to that question, read can I get in trouble for playing online casinos.

How to confirm a casino site is authorized in Delaware

  1. Go to the Delaware Lottery's website and open its iGaming section.
  2. Check that the site you're using belongs to Delaware Park, Bally's Dover or Harrington.
  3. Look for the Delaware Lottery's name on the site; authorized games run on the Lottery's BetRivers-powered platform.
  4. If a site offers real money casino games to Delaware residents and isn't on that list, treat it as unauthorized.
  5. Report concerns to the Division of Gaming Enforcement through its website.

Sweepstakes casinos in Delaware after the LuckyLand order

Delaware hasn't passed a sweepstakes ban statute. Instead, it used its existing law. The Division of Gaming Enforcement issued a cease-and-desist order to VGW, the company behind LuckyLand Slots, effective April 2, 2025. State officials said VGW had presented casino-style coin games as promotional sweepstakes when they were, in the state's view, illegal online slots.

That position covers the whole dual-currency model, where players buy Gold Coins and receive Sweeps Coins that can be redeemed for prizes. Several national brands now list Delaware as a restricted state; a third-party sweepstakes site's October 27, 2026 list for Chumba Casino includes it. A separate third-party report dates an earlier Delaware action that led VGW to leave the state to 2023, so accounts of the timeline differ.

Read sweepstakes casinos in Delaware for the detail, and sweepstakes casino laws for how other states handle these sites.

Delaware sports betting, the Lottery and daily fantasy

Sports betting is legal in Delaware and, like online casinos, runs through the Lottery under the Delaware Sports Lottery brand. The Delaware Sports Lottery page (opens in a new tab) describes Sports Pick retailers and sportsbooks at the three casinos; whether statewide mobile sports betting is available isn't described there, so check with the Lottery. The minimum age is 21. Our Delaware sports betting page has more.

The Delaware Lottery also sells traditional draw and instant games; its minimum age wasn't confirmed on the pages we used. Fantasy sports fall under Title 10 of the Delaware Administrative Code, the section covering charitable gaming, the Lottery and fantasy sports, so paid fantasy contests are a regulated activity.

What players in Wilmington, Dover and Newark should know

Delaware's largest cities are small by national standards. Census Bureau estimates for 2025 put Wilmington at about 73,512 people, Dover at 40,592 and Newark at 30,359. Because gambling law is set statewide, players in Wilmington, Dover and Newark all have the same three online casino brands and the same sportsbooks.

Geography matters in one way. Delaware borders Pennsylvania, New Jersey and Maryland, and licensed apps use location checks to make sure you are inside the state where they hold approval. Crossing into Pennsylvania or New Jersey puts you under that state's rules and licensed operators. See Pennsylvania online casinos and New Jersey online casinos for those markets.

Location checks matter most on a phone, which is why our Delaware mobile casinos guide covers them in detail. For every other state, start at our state-by-state online casino hub.

What real money casino play costs: a Delaware worked example

Every casino game has a house edge, so losses are likely over time whichever site you use. The expected cost of a session is the total you stake multiplied by the house edge. On online slots in Delaware, the edge depends on each game's RTP.

Bonuses make the arithmetic more interesting, and Silver Oak's own pages show why reading every term matters. Its new member offer page says 30x playthrough, while its general terms say 40x on slots, keno, bingo and scratch cards, and 60x on table games and video poker. Here's what that conflict means on a $100 deposit with a 100% match:

Same bonus, two published wagering figures
ItemAt 30xAt 40x
Deposit plus bonus$200$200
Wagering required$6,000$8,000
Expected cost at an illustrative 4% edge$240$320
Expected cost vs the $100 bonus$140 more than the bonus$220 more than the bonus

The figures above assume wagering applies to deposit plus bonus; if it applies to the bonus alone, the wagering is half as large. The 4% edge is an example, not a published figure for any game. The lesson holds either way: a high multiple can cost more than the bonus is worth, so ask support which figure applies before you accept. Our Delaware online casino bonuses and wagering requirements explained pages show the method, and no deposit bonuses in Delaware covers free chip offers and their caps.

Banking at offshore casinos from Delaware: cards, crypto and caps

Delaware's authorized online casinos handle payments as legal state gambling. Offshore sites are a different matter. Card networks code gambling as merchant category 7995, and many US banks decline those charges or treat credit card deposits as cash advances. Silver Oak's banking page lists card deposits from $30 to $1,000 with fees of 3% to 10%, against crypto deposits from $30 to $100,000 with no fee.

Withdrawals are where offshore play gets slow. The table shows what's published for the casinos with offers on this page.

Silver Oak's terms also describe a review stage of 7 to 10 business days followed by payment in 7 to 10 business days, and an 8% fee if a deposit wasn't wagered once. Crypto speeds up deposits, but federal consumer agencies warn that crypto payments generally can't be reversed. Read Delaware crypto casinos, fast payout casinos in Delaware and casino withdrawal limits before you deposit.

Delaware players and gambling taxes

Gambling winnings are taxable federal income, whether they come from Delaware Park, the state's online casinos or an offshore site. For payments made in 2026, slot, bingo and keno wins of $2,000 or more are reported on Form W-2G, and 24% withholding applies to certain other large wins, such as sports bets paying at least 300 times the stake where the win minus the wager exceeds $5,000.

Losses can be deducted only up to the amount of your winnings, and from the 2026 tax year the 2025 federal tax law reportedly limits the deduction to 90% of losses; check current IRS guidance. Offshore casinos may not send a W-2G, so keep your own records. Our gambling taxes guide and can I deduct gambling losses answer go further. Delaware's own income tax treatment isn't covered here; ask a tax professional.

Gambling help in Delaware

If gambling stops being fun, help in Delaware is a phone call away. The Delaware Council on Gambling Problems (opens in a new tab) runs a helpline at 1-888-850-8888, and the Lottery points players to it. The National Problem Gambling Helpline, run by the National Council on Problem Gambling, is 1-800-MY-RESET (1-800-697-3738), available by call, text or chat at any hour.

Practical ways to stay in control

  1. Decide how much you can afford to spend on gambling each month and treat it as the cost of entertainment.
  2. Set deposit limits or a cool-off period in your casino account before you play, not after a loss.
  3. Add a blocker such as Gamban (from $6.99 a month) or BetBlocker if you want to stop access to gambling sites.
  4. Talk to someone: the Delaware Council on Gambling Problems, 1-800-MY-RESET or a Gamblers Anonymous meeting.

Our pages on deposit limits and blocking software explain these tools step by step.

Frequently asked questions

Is it legal to play online casino games in Delaware?

Yes. Delaware authorized online casino games under the Delaware Gaming Competitiveness Act of 2012, and the Delaware Lottery runs them for Delaware Park, Bally's Dover and Harrington on a BetRivers-powered platform. Other real money casino sites are not authorized, and state officials say unlicensed real money games violate Delaware law. Our Delaware gambling laws page covers the statutes.

What online casinos are legal in Delaware?

Only the online casinos of Delaware Park, Bally's Dover and Harrington, offered through the Delaware Lottery. All three use the same BetRivers-powered platform, which is why the games and banking look similar across them. You can verify an authorized site through the Lottery's website. See real money online casinos in Delaware for how they compare with offshore sites.

Is it illegal to play at offshore casinos in Delaware?

Delaware officials say real money games offered by unlicensed entities violate the Delaware Constitution, the Penal Code and the 2012 Gaming Competitiveness Act, and they tell residents to play only at authorized Delaware casinos. We don't advise on any individual's legal position. Offshore casinos are not authorized in Delaware and offer no state protection. Read is it illegal to play at offshore casinos.

Does Delaware allow sweepstakes casinos like LuckyLand Slots?

Delaware treats them as illegal online slots. It has no specific ban statute, but the Division of Gaming Enforcement ordered VGW to stop offering LuckyLand Slots, effective April 2, 2025, saying it had dressed up casino-style coin games as promotional sweepstakes. Many brands now list Delaware as restricted. See Delaware sweepstakes casinos and are sweepstakes casinos legal.

How old do you have to be to gamble in Delaware?

You must be 21 to play casino games in person or online in Delaware, and 21 to bet on sports through the Delaware Sports Lottery. The minimum age for lottery tickets wasn't confirmed on the official pages we relied on, so check with the Delaware Lottery. Offshore casinos set their own ages. Compare with other states on gambling age by state.

Can I bet on sports online in Delaware?

Sports betting is legal in Delaware through the Delaware Sports Lottery, with Sports Pick retailers and sportsbooks at the three casinos. The Lottery page we checked doesn't describe statewide mobile betting, so confirm the current options with the Lottery. You must be 21. Our Delaware sports betting guide and sports betting laws explain the rules in more detail.

Do Delaware online casinos pay out faster than offshore casinos?

Payout speed varies, but the structure differs sharply. Authorized Delaware sites operate under state oversight, while offshore casinos set their own caps and timelines. Silver Oak's terms, for example, describe 7 to 10 business days of review plus 7 to 10 days of payment, and weekly caps from $2,500. See fast payout casinos in Delaware and how long casino withdrawals take.

Do I have to pay tax on casino winnings in Delaware?

Yes, gambling winnings are taxable federal income. For 2026 payments, slot and keno wins of $2,000 or more trigger a W-2G form, and the loss deduction is reportedly limited to 90% of losses from the 2026 tax year, so check IRS guidance. Offshore wins are taxable too, even without a form. Read what is a W-2G and our gambling taxes guide.

Where can I get help with gambling in Delaware?

Call the Delaware Council on Gambling Problems at 1-888-850-8888, or the National Problem Gambling Helpline at 1-800-MY-RESET (1-800-697-3738), which you can also text or reach by chat. Both are free and confidential. Gamblers Anonymous holds in-person and online meetings. Our help and support page and self-exclusion guide list more options.

Can I play Delaware's online casinos from Pennsylvania or Maryland?

No. Delaware's authorized online casinos use location checks to confirm you're inside Delaware before you can play for real money. Cross into Pennsylvania or New Jersey and you fall under that state's rules and its own licensed operators instead. Maryland doesn't license online casinos, so a Delaware account won't help there either. The rule follows where you are standing, not your home address. Read Delaware mobile casinos for how location checks work on a phone, and Pennsylvania online casinos for the market across the state line.

What does BetRivers have to do with Delaware online casinos?

BetRivers powers the shared platform behind all three of Delaware's online casino brands. The Delaware Lottery's iGaming page describes online games offered by Delaware Park, Bally's Dover and Harrington on that one BetRivers-powered system, which is why their lobbies and banking look alike. The Lottery, not BetRivers, is the state body that stands behind the games, and the Division of Gaming Enforcement handles enforcement. That's very different from an offshore casino, where the operator writes its own rules. Our Delaware gambling laws page explains the roles, and state gambling regulators compares other states.

How do I report an illegal online casino in Delaware?

Contact the Delaware Division of Gaming Enforcement through its website, which handles enforcement across the state's gaming industry. Delaware officials said in an April 7, 2025 release that real money games from unlicensed entities violate the state Constitution, the Penal Code and the 2012 Gaming Competitiveness Act, and told residents to verify authorized casinos through the Lottery. Note the site name, web address and any messages you received before you report. If you have money stuck at an offshore site, our guides on filing a casino complaint and cease-and-desist letters explain what other routes exist.

What is the minimum deposit at Silver Oak for Delaware readers?

Silver Oak's banking page lists $30 as the minimum deposit for both cards and crypto. Card deposits run from $30 to $1,000 with fees of 3% to 10%, while crypto deposits run from $30 to $100,000 with no fee. A $100 card deposit could therefore cost up to $10 before you play. Its terms also describe an 8% fee if a deposit wasn't wagered once before withdrawal. Silver Oak is offshore and not authorized by Delaware. Read the Silver Oak review and minimum deposits before you choose a method.

Is Silver Oak's bonus wagering 30x or 40x for Delaware players?

Silver Oak's own pages give both figures, so ask support which applies before you accept a bonus. Its new member offer page says 30x playthrough, while its general terms say 40x on slots, keno, bingo and scratch cards and 60x on table games and video poker. On a $100 deposit with a $100 match, wagering on deposit plus bonus means $6,000 at 30x or $8,000 at 40x. At an illustrative 4% house edge, that's an expected cost of $240 or $320. Our Delaware online casino bonuses page and bonus wagering requirements guide show the full method.
