Are online casinos legal in West Virginia?

Yes. West Virginia authorized interactive wagering, which covers online casino games, in fiscal year 2020 through the West Virginia Lottery Interactive Wagering Act. Sites that operate under that law are licensed and supervised by the West Virginia Lottery Commission (opens in a new tab), the same agency that runs the state lottery and oversees its land-based casinos.

That puts the Mountain State in a small group. Only New Jersey, Pennsylvania, Michigan, West Virginia, Delaware, Connecticut and Rhode Island license real-money online casinos, as our list of states with legal online casinos explains. Everywhere else, no state license exists for online slots or table games.

One limit is written into the statute itself. W. Va. Code §29-22E-6 (opens in a new tab) allows up to five interactive wagering licenses. How many operators currently hold one isn't published in the sources we used, so check the regulator's own list before you sign up anywhere. For the statute-by-statute picture, see our page on West Virginia gambling laws.

How the Lottery Commission licenses West Virginia online casinos

West Virginia built its online market on top of its existing casino industry. The state counts five land-based casinos: four racetrack casinos and one historic resort hotel casino. Interactive wagering lets licensed operators take bets online from players located in the state, under the Lottery Commission's rules.

A state license changes what happens when something goes wrong. A licensed site answers to a US regulator, has to follow the state's rules on things like age checks and player funds, and can lose its license if it breaks them. That's the core of the difference we cover in player protections at offshore vs licensed casinos.

Reported age rules are stricter than for the lottery. A July 2026 news report on West Virginia's regulation of online casino gaming gives the minimum age for interactive wagering as 21, while the lottery minimum is 18. Offshore casinos set their own age rules, which can differ.

How to check that a West Virginia casino site is state-licensed

  1. Find the operator's legal name in the site's footer or terms, not just the brand name on the homepage.
  2. Compare it with the operators listed by the West Virginia Lottery Commission on its business site.
  3. Check that the site asks for your location and verifies your age and identity before you play, as licensed sites must keep players in-state and of age.
  4. Read who handles complaints. A state-licensed site points to the Lottery Commission; an offshore site points to itself or a foreign body.
  5. If you can't match the brand to a state licensee, treat it as an unlicensed offshore casino and read the risks below before depositing.

State-licensed vs offshore online casinos in West Virginia

Readers in West Virginia have a choice most Americans don't: a regulated in-state market. That's why we put the comparison up front. The offers shown on this page are from offshore casinos, which sit outside that regulated market entirely.

Licensed West Virginia sites compared with offshore casinos
QuestionState-licensed WV siteOffshore casino

None of this means a licensed site is a good bet financially. Every casino game carries a house edge, so losses are the likely result over time wherever you play. The difference is about recourse: who you can turn to if a balance is frozen or a withdrawal disappears.

Offshore real money casinos and West Virginia players

Offshore casinos are run from outside the US and are not licensed by West Virginia. The three we show offers for, Silver Oak Casino, Planet 7 Casino and Royal Ace Casino, all fall in this group. A West Virginia statute specifically addressing illegal online gambling wasn't identified in the sources we used, so we can't tell you how state law treats a player who uses one. What is clear is that they sit outside the state's licensing system.

Licensing claims for these brands are thin and sometimes contradict each other. Silver Oak's own terms say it is run by Primrose Media Limited and licensed in Anjouan, with no license number shown; one third-party listing says it has no license. Third-party reviews describe Planet 7 and Royal Ace as holding a Costa Rica license or none at all, and none of those reviews shows a license number. Our Anjouan license explainer covers what that kind of license does and doesn't mean.

State regulators elsewhere have acted against two of them. The Michigan Gaming Control Board's April 9, 2025 cease-and-desist release (opens in a new tab) names Silver Oak Casino and Planet 7 Casino among 13 unlicensed offshore operators it called illegal in Michigan. Royal Ace doesn't appear in any of the three Michigan releases we track. Read more in our page on cease-and-desist letters.

Offshore sites also choose which states to accept. Bovada's own help page, for example, lists West Virginia among the US states it does not serve. None of our three partners publishes a full list of restricted US states, and no third-party report we hold says any of them refuses West Virginia players, so confirm eligibility in the casino's terms at sign-up. If you want the full real-money picture, our page on real money casinos in West Virginia goes deeper.

Offshore means no West Virginia regulator to complain to, no state-backed protection of your balance, and terms the casino sets and can change. Check the law and the casino's current terms before you deposit.

West Virginia's racetrack and resort casinos

West Virginia's casino industry predates its online market by decades, and that history shapes how the state regulates. The Lottery Commission counts five land-based casinos: four attached to racetracks and one historic resort hotel casino. Interactive wagering licenses are tied to that existing industry under the 2020 law.

For players, the practical point is simple. If you want table games or slots with a state regulator behind them, those five venues and the state-licensed online sites linked to the market are the regulated options. Offshore casinos are a separate category with their own risks.

If you're comparing the legal picture with nearby states, see our page on Pennsylvania, which also licenses online casinos, while neighboring Ohio does not. The states hub has all 50 states and DC.

West Virginia sports betting, the lottery and daily fantasy

Sports betting is legal in West Virginia. The state authorized sports wagering in fiscal year 2018, the same year the Supreme Court's Murphy v. NCAA ruling let states legalize it. The year online sports betting launched, and the number of licensed sportsbooks, aren't published in the sources we used. Our page on West Virginia sports betting has more.

The West Virginia Lottery is the regulator and the lottery operator at once. The minimum age to play the lottery is 18. Whether tickets can be bought online isn't confirmed in the sources we used, so check the Lottery's own site.

Daily fantasy sports status wasn't recorded for West Virginia in our sources. Check with the Lottery Commission before entering paid contests.

Sweepstakes casinos in West Virginia: VGW's exit and brand exclusions

Sweepstakes casinos use two currencies: Gold Coins for play with no cash value and Sweeps Coins that can be redeemed for prizes. West Virginia has no sweepstakes casino ban or bill on record in the sources we used. Even so, many brands have stopped taking West Virginia players on their own.

The biggest move came from VGW, the group behind Chumba Casino and LuckyLand Slots. A sweepstakes review site reports that VGW announced on November 6, 2025 that it was withdrawing Sweeps Coins play from West Virginia, a company decision rather than a state order. Chumba's own sweepstakes rules dated August 28, 2025 don't list West Virginia, which shows how quickly these lists go out of date.

What players in Charleston, Huntington and Morgantown should know

Whether you live in Charleston, Huntington or Morgantown, the state's three largest cities, the same rule applies: what matters legally is where you are when you play, not where you live. State-licensed sites check your location and only accept bets from inside West Virginia.

That matters near the borders. A player in Huntington who crosses into Ohio or Kentucky is outside West Virginia's licensed market, and those states don't license online casinos. A Morgantown player who crosses into Pennsylvania falls under that state's separate licensing system.

Most people play from a phone. Licensed and offshore sites alike tend to run in the browser. Silver Oak's site says it offers instant play in mobile browsers and lists no dedicated app, and third-party reviews describe Planet 7 the same way. Phone play is covered in more depth on West Virginia mobile casinos.

West Virginia casino bonuses and no deposit offers: what they cost

Casino bonuses come with conditions that decide what they're worth. The key ones are wagering (how many times you must bet the bonus, or bonus plus deposit, before withdrawing), the max cashout and which games count. Offers are compared on West Virginia casino bonuses; here is how the math works on one published package.

Silver Oak is a useful example because its own pages disagree. The new-member offer page says 30x playthrough (60x on blackjack and video poker), while the general terms say 40x on slots, keno, bingo and scratch cards and 60x on table games and video poker. The offer page also says there is no max withdrawal on that package. Deposits start at $30, according to its banking page.

Worked example: $100 deposit, 100% match, assuming wagering on bonus plus deposit
ItemAt 30x (offer page)At 40x (terms)
Deposit$100$100
Bonus (100% match)$100$100
Amount to wager ($200 × multiple)$6,000$8,000
Expected loss at a hypothetical 4% house edge$240$320
Expected balance left from $200about -$40about -$120

On average, then, a player expects to use up the whole bonus and some of the deposit before clearing it. Results vary widely around that average, which is what makes slots feel unpredictable. Silver Oak's terms also list games excluded from bonus play, including baccarat, craps, roulette, pai gow poker, live dealer games and progressives, so table games are mostly off the table for clearing a bonus.

Silver Oak's site also lists no-deposit chips: codes SILVER25 ($25), SILVER50 ($50) and FREESILVER ($100), with 30x wagering (60x on blackjack and video poker) and a $100 max cashout. Codes change, so check them on the day. The West Virginia no deposit bonuses page explains how free chips work and why the cap matters.

Bitcoin, cards and withdrawal limits for West Virginia players

Banking is where offshore and licensed casinos differ most in practice. US card issuers often decline gambling transactions coded MCC 7995, and offshore casinos lean on crypto as a result. Our page on card declines explains why a deposit can fail.

Published or reported withdrawal terms at the three partners shown here
CasinoWithdrawal capTimesSource type
Silver OakFrom $2,500 weekly (higher by VIP level)Review 7–10 business days, then payment 7–10 business daysCasino's own terms
Planet 7$2,500 per week; one listing shows 2,500 euros per dayPending 5–7 days, then 7–9 days; one reviewer says over a monthThird-party reviews (conflicting)
Royal Ace$2,500 per week, $5,000 per monthPending 7–10 days, then 10–14 days; one reviewer says a month or moreThird-party reviews

Those caps matter more than the bonus size. At $2,500 a week, a $10,000 balance takes four weeks to withdraw if every request goes smoothly. Silver Oak's terms also charge an 8% fee (minimum $4) if a deposit hasn't been wagered at least once before you withdraw.

Crypto is the main route. Silver Oak's banking page lists Bitcoin, Litecoin and Ethereum deposits from $30 to $100,000 with no fee, and Bitcoin withdrawals from $50 to $2,500. Crypto payments generally can't be reversed, so a mistake or a dispute can't be charged back. See West Virginia crypto casinos and the fast payout casinos in West Virginia page before you choose a method.

Online slots West Virginia players will see at offshore sites

The three offshore partners shown here run RealTime Gaming software. Silver Oak's mobile page names RTG titles such as Storm Lords, T-Rex II and Cash Bandits 3, and third-party reviews report Cash Bandits 2, Cash Bandits 3 and Paydirt! in the Planet 7 and Royal Ace lobbies. Check each casino's lobby, since titles change.

Third-party reviews report no live dealer games at Silver Oak or Planet 7. If live tables matter to you, that's one area where the state-licensed market may suit you better. Our online slots in West Virginia page covers RTP and volatility in plain terms.

Federal law and gambling taxes for West Virginia players

Federal law mostly targets operators, not players. The Unlawful Internet Gambling Enforcement Act of 2006 bars gambling businesses from accepting payments for unlawful internet gambling, and it defines "unlawful" by reference to state law. It does not make placing a bet a federal crime for the player. Our UIGEA page has the detail.

Winnings are taxable federal income whether you win at a licensed site, a land casino or an offshore casino. For 2026, the IRS W-2G instructions (opens in a new tab) set a $2,000 reporting threshold for slot, bingo and keno winnings. Regular 24% withholding applies to some other winnings over $5,000, but not to slots, bingo or keno.

Losses are deductible only up to your winnings. From the 2026 tax year, the 2025 federal tax law reportedly caps that deduction at 90% of losses, as reported; check IRS guidance. How West Virginia taxes gambling income at the state level isn't covered in the sources we used. Our gambling taxes guide walks through record-keeping.

Problem gambling help in West Virginia

Gambling should cost only what you'd spend on any other night out. If it's costing more than that, help is free and confidential. The National Problem Gambling Helpline (opens in a new tab), run by the National Council on Problem Gambling, is 1-800-MY-RESET (1-800-697-3738), with call, text and chat, 24 hours a day.

Other options include Gamblers Anonymous meetings, blocking software such as Gamban or BetBlocker, and the limit and self-exclusion tools that casinos offer. Silver Oak's terms list deposit limits, cool-off periods and self-exclusion through live chat. Each tool is explained step by step in our responsible gambling hub.

In a crisis, call or text 988, or call 911.

Frequently asked questions

Is it legal to play real money online casinos in West Virginia?

Yes, at sites licensed by the West Virginia Lottery Commission. The state authorized interactive wagering in fiscal year 2020, and the statute allows up to five interactive licenses. Sites without a West Virginia license, including the offshore casinos we show offers for, are outside that regulated market and come with no state protection. Read West Virginia gambling laws for the statute-level detail and how the licenses work.

What is the minimum age for online casinos in West Virginia?

The reported minimum age for online casino play in West Virginia is 21. A July 2026 news report on the state's regulation of online casino gaming gives that age for interactive wagering, while the lottery minimum is 18. Offshore casinos set their own rules; Silver Oak's terms say 21 or the local legal age if higher. Our gambling age by state table compares every state.

Who regulates online gambling in West Virginia?

The West Virginia Lottery Commission regulates online casinos, sports betting, the land-based casinos and the state lottery. That single agency licenses interactive wagering operators under the 2020 law. It has no authority over offshore casinos, which hold foreign licenses or none. Our overview of state regulators shows which agency handles gambling in each state and how to contact them.

Can I play at offshore casinos from West Virginia?

Offshore casinos are not licensed by West Virginia, and the sources we used don't record a state statute or regulator statement on players who use them. Many offshore sites accept West Virginia players, though some, like Bovada, list the state as restricted. If you play offshore, you give up state complaint routes and protections. Read is it illegal to play at offshore casinos before deciding.

Do sweepstakes casinos still accept West Virginia players?

Many don't, even though no West Virginia ban or bill on sweepstakes casinos appears in the sources we used. VGW, which runs Chumba Casino, reportedly withdrew Sweeps Coins play from West Virginia in November 2025, and McLuck, High 5 Casino, Modo.us and Stake.us list the state as excluded in their own rules. See West Virginia sweepstakes casinos for current lists.

Is sports betting legal in West Virginia?

Yes. West Virginia authorized sports wagering in fiscal year 2018, and the Lottery Commission regulates it. The year online sports betting launched and the current number of licensed sportsbooks aren't published in the sources we used. Bettors must be in the state when placing a bet with a licensed sportsbook. Our West Virginia sports betting page has the full picture.

Do I pay tax on online casino winnings in West Virginia?

Yes, gambling winnings are taxable federal income wherever you win them. For 2026, casinos file a Form W-2G for slot, bingo or keno wins of $2,000 or more, and losses are deductible only up to your winnings, reportedly capped at 90% of losses from the 2026 tax year; check IRS guidance. Offshore casinos may not send you a form, but the income is still taxable. See do I pay tax on casino winnings.

What are the best online casinos in West Virginia?

For regulated play, the best starting point is a casino licensed by the West Virginia Lottery Commission, because it comes with state oversight. The offshore casinos we list, Silver Oak, Planet 7 and Royal Ace, are ranked commercially and are not licensed by the state. Compare their weekly withdrawal caps and wagering terms before you choose. Our real money casinos in West Virginia page compares them.

Where can I get help for problem gambling in West Virginia?

Call or text the National Problem Gambling Helpline at 1-800-MY-RESET (1-800-697-3738), free and confidential at any hour, or use its online chat. Gamblers Anonymous runs in-person and online meetings, and blocking apps such as Gamban stop access to gambling sites on your devices. In a crisis, call or text 988. Our responsible gambling hub has step-by-step guides.

How many online casinos are licensed in West Virginia?

State law allows at most five interactive wagering licenses, under W. Va. Code §29-22E-6, but the current number of licensed operators isn't published in the sources we used. Licenses are tied to the state's existing casino industry of five land-based venues, four racetrack casinos and one historic resort hotel casino. Check the West Virginia Lottery Commission's business site for the current list before signing up. A site that isn't on it isn't licensed in the state. Our West Virginia real money casinos page and state regulators guide explain how to check.

Can I play West Virginia online casinos from Ohio or Kentucky?

No, West Virginia's licensed online casinos accept bets only from players physically located inside West Virginia, whatever their home address. State-licensed sites check your location before you play. A Huntington resident who crosses into Ohio or Kentucky leaves West Virginia's licensed market, and neither of those states licenses online casinos. A Morgantown player who crosses into Pennsylvania falls under that state's own licensing system instead. Offshore sites that ignore state lines aren't West Virginia licensees. See online casinos in Ohio for that state's position, and our guide to traveling and online casinos covers location checks.

What can I do if a West Virginia licensed online casino won't pay me?

Raise it with the operator first, then take it to the West Virginia Lottery Commission if it isn't resolved, because a state-licensed site answers to that regulator. Licensed operators must follow state rules on age checks and player funds, and the commission can fine them or take away a license. That route doesn't exist at offshore casinos, where complaints go to the casino itself or a foreign body, if any. Keep records of your account, requests and replies either way. Our player protections offshore vs licensed guide and how to file a casino complaint walk through the steps.

How long does a Royal Ace withdrawal take from West Virginia?

Roughly two to three and a half weeks, based on reviews reporting a pending period of 7 to 10 days and then 10 to 14 days for payment; one reviewer says a month or more. Royal Ace is an offshore casino, not licensed by West Virginia or any US state, and its terms aren't confirmed on its own site in the sources we hold. Reviews report a $2,500 weekly and $5,000 monthly cap, which means a $10,000 win would take at least two months to collect. Can I play online casinos on my phone in West Virginia?

Yes, West Virginia's state-licensed online casinos can be played on a phone, as long as you're physically inside the state when you play, since licensed sites check your location. Licensed and offshore sites alike tend to run in the mobile browser. Silver Oak's site says it offers instant play in mobile browsers with no dedicated app, and third-party reviews describe Planet 7 the same way, but both are offshore and outside the Lottery Commission's oversight. The same rules apply in Charleston, Huntington and Morgantown. See West Virginia mobile casinos and the playing on Android guide.

Do offshore casinos offer live dealer games to West Virginia players?

Not at the two partners checked: third-party reviews report no live dealer games at Silver Oak or Planet 7. All three offshore casinos shown on this page run RealTime Gaming software, with slots such as Storm Lords, T-Rex II and Cash Bandits 3 named on Silver Oak's mobile page. Silver Oak's terms also exclude live dealer games from bonus play. If live tables matter to you, West Virginia's state-licensed market may suit you better, so check what each licensee offers.
