Gambling age by state

The gambling age by state is set by each state, not by federal law, and it's usually 21 for casinos and online casinos and 18 or 21 for lottery, sports betting and fantasy contests. Below is every state's verified age, where it comes from, and the gaps where no reliable source confirms it.

Key takeaways

  • There's no federal gambling age; each state sets its own, often by type of gambling.
  • Every state that licenses online casinos and has a confirmed age requires players to be 21.
  • Lottery is often 18, and sports betting is 21 in most states with a confirmed age, but New Hampshire and DC allow 18.
  • Offshore casinos set their own minimums: Silver Oak's terms say 21, SlotoCash's say 18, and state law still applies to you.
  • Ages change; check your state regulator before you play.

The gambling age by state: the short answer

In most states the legal gambling age is 21 for casinos, online casinos and sports betting, and 18 for the lottery. But there's no single national rule. Each state writes its own, sometimes with different ages for different products in the same state, so a 19-year-old can buy a lottery ticket in one place and be turned away from a sportsbook in the same building.

The ages below come from state regulators and statutes where possible, with industry summaries filling some gaps and labeled as third-party. Where a cell says "Not confirmed", no official or reliable source confirmed that age as of October 28, 2026, so ask the regulator. Our state regulators page tells you who that is, and the US gambling laws hub covers the wider rules.

Being old enough doesn't make a product legal. Online casinos are licensed in only seven states, and the age rules on this page apply to the legal, state-regulated options.

Most of the third-party figures come from the American Gaming Association's State of the States 2026 (opens in a new tab), which lists a single statewide minimum age for several states. Treat those as reliable but secondary, and confirm with the state where it matters.

Online casino age in the states that license them

In the states that license real-money online casinos and publish an age, it's 21. Connecticut's Department of Consumer Protection lists 21 for online casino play on its legal gaming in Connecticut page (opens in a new tab). Delaware's lottery-run online casino requires 21, as its iGaming page (opens in a new tab) explains. Michigan's Gaming Control Board sets 21 for an internet wagering account in its sports and internet betting FAQ (opens in a new tab).

Sports betting age by state

Sports betting is 21 in nearly every state where the age is confirmed, including Colorado, Indiana, Michigan, Missouri, New York, North Carolina, Tennessee and Vermont. Two exceptions stand out. New Hampshire's sports betting law, RSA 287-I (opens in a new tab), sets 18, and the District of Columbia's Office of Lottery and Gaming allows sports betting at 18.

Nevada's law is unusually clear: NRS Chapter 463 (opens in a new tab) prohibits gaming by anyone under 21, which covers both casinos and sportsbooks. Our sports betting laws page and the New Hampshire and District of Columbia hubs have more.

Lottery and daily fantasy age by state

Lotteries usually start at 18. The age is confirmed at 18 in California, Connecticut, DC, Georgia, Missouri, New Hampshire, Rhode Island, Virginia and West Virginia. Alabama and Utah have no state lottery, and none was found for Nevada. Our guide to state lotteries online covers where you can buy tickets online.

Daily fantasy contests are a separate product with their own ages. Connecticut, Michigan and Ohio set 18, Kentucky's 2026 HB 904 sets 18 for its new licensing system, and Louisiana requires 21. See daily fantasy sports laws for the status in each state.

Is there a federal gambling age?

No. Federal laws such as the Wire Act and UIGEA target gambling businesses and payments, not player age. Age limits come from state statutes, regulator rules and, for tribal casinos, tribal-state compacts. North Carolina's Eastern Band of Cherokee casinos, for example, use 21 under a compact amended in 2001, as reported by a third-party source.

Congress has looked at age in the prediction market debate. The Prediction Markets Security and Integrity Act of 2026 (S. 4060) would set a 21+ minimum for prediction markets, and the GAME Act of 2026 (S. 4555) would bar targeted ads promoting sports gambling platforms to minors. The Congressional Research Service listed neither as enacted in August 2026. Our prediction markets page tracks those bills.

What age offshore casinos require

Offshore casinos set their own minimum ages in their terms, and they don't always match US state law. That doesn't change your state's law. If your state sets 21, a casino that accepts 18-year-olds doesn't make it lawful for an 18-year-old there to play.

Age checks happen through identity verification. Silver Oak's terms, for example, ask for government photo ID, a selfie with the ID and a recent utility bill, and block withdrawals until checks are complete. Read why the casino wants your documents and our guide to verifying your casino account.

How to check the gambling age where you live

  1. Find your state in the table above and note the age for the product you want.
  2. If it says "Not confirmed", go to your state regulator's website and look for an FAQ or responsible gaming page.
  3. Check whether the age is different for online play, retail play, lottery or fantasy.
  4. For tribal casinos, check the casino's own rules, since compacts can set the age.
  5. If you're thinking about an offshore casino, read its terms for its minimum age and check your state's law on online casinos too.
  6. Have valid government ID ready; licensed and offshore sites both ask for it before paying out.

Underage gambling and keeping young people safe

Age limits exist because younger people are more vulnerable to gambling harm. If you share devices with teenagers, blocking software helps. Gamban, for example, costs $6.99 a month or $41.99 a year with a 7-day free trial, and blocks gambling sites and apps. Our pages on young people and gambling and Gamban have more.

Frequently asked questions

What is the legal gambling age by state in the US?

There isn't one national age. Each state sets its own, and it often differs by product. Casinos and online casinos are 21 in every state where the age is confirmed, sports betting is usually 21, and lotteries are usually 18. New Hampshire and DC allow sports betting at 18. Check the table on this page and your state's regulator. Our what age to gamble online page gives the short version.

Can you gamble at 18 in any state?

Yes, for some products. Lotteries are 18 in states including California, Georgia, Missouri and Virginia, sports betting is 18 in New Hampshire and DC, and daily fantasy is 18 in Connecticut, Michigan, Ohio and, under its new law, Kentucky. Casino gaming is 21 wherever the age is confirmed here. See can I play at 18 for more detail.

What is the online casino age in states where it's legal?

It's 21 wherever it's confirmed. Michigan, Connecticut and Delaware state 21 in official sources, and New Jersey, West Virginia and Rhode Island are reported at 21 by third parties. Pennsylvania's age wasn't confirmed by a source available here, so check with its Gaming Control Board. Maine's proposed tribal online casino rules also set 21. See which states allow online casinos.

What age do offshore casinos require?

It varies by casino. Silver Oak's terms set 21 or the local legal age if higher, Miami Club's terms say 18 or the local legal age, SlotoCash's terms say 18+, and third-party reviews report 21+ at Planet 7. Decode, Royal Ace and Slot Madness don't publish an age in the sources available. Your state's law applies whatever a casino accepts. Read is it illegal to play at offshore casinos.

Do online casinos check your age?

Yes, usually through identity checks before you can withdraw. Silver Oak's terms list government photo ID, a selfie with the ID and a utility bill from the last three months, and they block withdrawals until checks are done. Federal law expects it of licensed sites too: UIGEA's carve-out for state-authorized intrastate wagers requires age and location verification. See do I need ID to play.

Is the casino age different at tribal casinos?

It can be, because tribal-state compacts can set the age. North Carolina's Eastern Band of Cherokee casinos use 21 under a compact amended in 2001, according to a third-party source. Other tribal casinos may differ, so check the casino's own rules or the state's compact. Our tribal gaming page explains how compacts work under the Indian Gaming Regulatory Act.

Is the sports betting age the same as the casino age?

Usually, but not always. In Nevada, NRS 463.350 bars anyone under 21 from gaming, which covers casinos and sportsbooks alike, and Michigan, Connecticut and Delaware also use 21 for both. New Hampshire is different: its sports betting law sets 18, and DC also allows sports betting at 18 while having no casinos. Check both columns in the table above. Our is sports betting legal in my state page covers where it's offered.

What happens if you gamble underage at an online casino?

Age problems usually surface at the identity check before a withdrawal. Silver Oak's terms, for example, block withdrawals until ID checks are complete, so an underage player shouldn't expect to be paid. Breaking a casino's age rule also means breaking its terms. The safest step is simply not to gamble until you're old enough where you live. If gambling is a problem at any age, call 1-800-MY-RESET. See young people and gambling.

How old do you have to be to gamble in Nevada?

The gambling age in Nevada is 21, and the rule is written straight into state law: NRS 463.350 prohibits gaming by anyone under 21, which covers the state's casinos and its sportsbooks alike. Nevada licenses online poker, but real-money online casino games aren't legal there. No Nevada state lottery was found in the sources checked, so the 18-year-old lottery age that many states use doesn't come into play. Visitors face the same 21 rule as residents. Our Nevada gambling laws page covers the Gaming Control Board's other rules.

Can you bet on sports at 18 in New Hampshire?

Yes, New Hampshire's sports betting law, RSA 287-I, sets the minimum age at 18, one of the few places in the US below 21. Betting runs through the New Hampshire Lottery, with DraftKings as its online and retail operator, and the lottery age is also 18. A casino age wasn't confirmed in the sources checked, and real-money online casinos aren't legal in the state. Being 18 doesn't make offshore casino play lawful there either. See our New Hampshire sports betting page for how the market works.

How old do you have to be to gamble in Missouri?

Missouri sets 21 for casinos and sports betting and 18 for the lottery. The Missouri Gaming Commission's launch notice confirms 21 for sports wagering, which went live online and at retail on December 1, 2025, and the American Gaming Association lists 21 for the state's 13 commercial casinos. Online casinos aren't legal in Missouri. If gambling becomes a worry, the state lists 1-888-BETSOFF alongside the national 1-800-MY-RESET line. Our Missouri sports betting page explains the newly licensed market.

What is the gambling age in Washington, DC?

The District of Columbia allows sports betting and the DC Lottery at 18, according to its Office of Lottery and Gaming, and it has no casinos, so there's no casino age to meet. DC licenses sports wagering at venues, at set locations and online districtwide, but bars wagering in federal enclaves. No official DC statement on online casinos was found, so don't read the 18 sports betting age as permission to play casino games online. Our District of Columbia gambling laws page explains what the District licenses.

What is the minimum age at Miami Club Casino?

Miami Club's terms set the minimum age at 18 or the local legal age, whichever is higher, so a player in a state that uses 21 would need to be 21. Proof of identity is required for every withdrawal, which is where age gets checked. The same Terms of Use (v2.1, September 28, 2026, section 1.6) list the United States as a prohibited jurisdiction, while the site owner's affiliate program confirms US players are accepted, so confirm eligibility at sign-up. Miami Club isn't licensed by any US state. Our Miami Club review has its other terms.
