Kentucky gambling laws allow licensed sports betting, pari-mutuel horse racing, the state lottery and, since 2026, licensed fantasy contests, but they do not authorize online casino games. The Kentucky Horse Racing and Gaming Corporation regulates most of it, and no Kentucky license covers an online slots or blackjack site.
Online casinos are not legal in Kentucky, according to the American Gaming Association's 2026 survey.
HB 551 (2023) legalized sports betting at licensed racetracks and on up to 27 mobile apps; it launched in September 2023.
HB 904 (2026) became law over the governor's veto and creates a KHRGC license for fantasy contests, open at 18.
The Kentucky Lottery sells some games online, and the AGA counts no commercial casinos in the state.

Kentucky gambling laws at a glance
Kentucky built its gambling market around horse racing, and the law still reflects that. Sports betting runs through the state's licensed racetracks, the same corporation that oversees racing regulates wagering, and casino-style gaming has never been authorized online. Who regulates gambling in Kentucky: the KHRGC
The Kentucky Horse Racing and Gaming Corporation (opens in a new tab) is the state's main gambling regulator. It licenses racing, oversees sports wagering under HB 551 and, under HB 904, now licenses fantasy contest operators too. The lottery runs separately as the Kentucky Lottery.
We found no KHRGC statement about offshore online casinos. That silence does not make those sites lawful in Kentucky; it simply means the regulator's published material focuses on the markets it licenses. Our list of state gambling regulators shows how Kentucky's single-agency setup compares with other states.
Kentucky sports betting law: HB 551
House Bill 551 passed in 2023 and made Kentucky one of the fastest launches after the Supreme Court's Murphy v. NCAA ruling let states decide. Retail betting started on September 7, 2023, and mobile betting followed on September 28, 2023, according to the KHRGC's sports wagering FAQ (opens in a new tab).
The model ties every license to racing. Each of nine licensed racing facilities may apply for up to three mobile app partners, so the ceiling is 27 apps, though the total actually licensed is not published. Betting age under HB 551 was not confirmed on the pages researchers could read, so check the operator's terms. Our Kentucky sports betting page covers apps and markets.
HB 904 (2026): fantasy contests and prediction markets
The biggest recent change is House Bill 904 (opens in a new tab). The governor vetoed it and the General Assembly overrode the veto, so it is law. It does three things that matter to players:
Creates a KHRGC licensing system for fantasy contests, open to participants aged 18 or older who are physically in Kentucky.
Adds legal definitions for prediction markets and event contracts.
Requires online gaming operators to block accounts that appear on the state's child-support arrearage registry.
Prediction markets are also in court. Kentucky's Attorney General filed a complaint against Kalshi and others in Franklin Circuit Court, dated June 17, 2026, over event contracts; the case details were not available to review. Our guide to prediction markets follows the federal bills on the same question.
Are online casinos legal under Kentucky gambling laws?
Offshore sites still market to players in Louisville and Lexington. Those casinos are licensed, if at all, outside the US. Kentucky gives them no license, and no state regulator handles complaints about them. Our explainer on offshore casino legality covers what that means in practice, and our Kentucky real money casinos page looks at deposits, withdrawals and taxes.
Penalties under Kentucky and federal gambling law
A Kentucky statute on illegal online gambling, with its penalty level, was not confirmed on an official page during our research, so we do not quote one here. Read the Kentucky Revised Statutes directly, or ask a Kentucky attorney, if you need the exact offense and penalty.
Federal law aims at operators rather than players. The table lists the main statutes and their penalties as written.
Federal gambling laws and who they target
Law
Who it targets
Penalty or effect
Wire Act, 18 U.S.C. § 1084
Businesses that take bets by wire
Fine, up to two years in prison, or both; applies to sports betting per the 2021 First Circuit ruling
UIGEA, 31 U.S.C. §§ 5361–5367
Gambling businesses accepting payments
Bars accepting cards, transfers and checks for unlawful internet gambling; does not make a player's bet a federal crime
Kentucky's ages are less settled in published sources than most states'. HB 904 sets fantasy contests at 18. The betting age under HB 551 and the lottery age were not confirmed on the official pages researchers could read, and there are no commercial casinos to set a casino age.
No sweepstakes casino ban was found for Kentucky, based on a third-party tracker. That contrasts with Tennessee, which banned them from May 22, 2026, and Indiana, which did so from July 1, 2026. Sweepstakes sites use a dual-currency model of Gold Coins and Sweeps Coins and say they are not gambling; read Kentucky sweepstakes casinos before you try one.
The Kentucky Lottery sells tickets in stores and, per a third-party source, some games online since roughly 2019. It is the only state-run option for casino-style instant games on a phone in Kentucky.
Recent Kentucky gambling bills and what is next
Recent law changes have come in a clear order:
2023: HB 551 legalizes sports betting; retail opens September 7 and mobile September 28.
2026: HB 904 becomes law over a veto, licensing fantasy contests and defining prediction markets.
June 17, 2026: the Attorney General's complaint against Kalshi and others is dated in Franklin Circuit Court.
October 2026: online casino games remain unauthorized, with no sweepstakes ban recorded.
No Kentucky bill to legalize online casinos was recorded in the sources we used. If one is filed, the KHRGC's role in sports and fantasy makes it the likely regulator, but that is a guess, not a fact. Track changes on our Kentucky casino bonuses and hub pages, which we update as the law moves.
Taxes and problem gambling help in Kentucky
Gambling winnings are federal taxable income. Payers file a W-2G for slot winnings of $2,000 or more paid in 2026, and the loss deduction is reported to be capped at 90% of losses from the 2026 tax year; check IRS guidance. Kentucky income tax questions belong with the Kentucky Department of Revenue. Our gambling taxes page explains the federal rules.
Because Kentucky gambling laws license no online casino, any real-money casino site a Kentucky player uses is offshore. The two partners below are offshore and not licensed by Kentucky or any US state; check Kentucky law, and weigh the lack of a state complaint route and of protection for balances, before signing up. Offers are for new players, 21+ (18+ where allowed), and terms apply.
SlotoCash Casino: $6,000 Welcome Bonus + 60 Free Spins, via our link (new players, 21+ or 18+ where allowed, terms apply). Its own bonus terms list a $20 minimum deposit per bonus, 25x (deposit + bonus) wagering and no max cashout (primary). The site advertises a different package from the one via our link, so the terms shown at sign-up apply. Michigan's regulator named SlotoCash in an October 8, 2026 cease-and-desist release.
Decode Casino: $5,000 Welcome Bonus + 50 Free Spins, via our link (new players, 21+ or 18+ where allowed, terms apply). Its own pages show no terms, and third-party reviews report codes such as DECODE111 (111% up to $1,111, 25x, $25 minimum); codes change, so check the cashier. Reviewers report that Decode refuses players from Maryland, New Jersey, New York and Washington.
Free spins and match bonuses are slot-focused; table games are often excluded or weighted lower, and the house edge means losses are likely over time. Read the SlotoCash review and the Decode review first. We earn a commission from partners and rank them in a commercial order.
Ad21+ (18+ where allowed). Ranked by us in a commercial order; we earn commission from these links. Advertiser disclosure
These offers come from offshore casinos that Kentucky does not license. Read the law above before you decide anything.

Frequently asked questions
Is online gambling legal in Kentucky?
Some of it is. Kentucky allows licensed online sports betting under HB 551, licensed fantasy contests under HB 904 and some online lottery sales, but it does not authorize online casino games. The AGA lists online casinos as not legal there. Offshore casino sites are not licensed by Kentucky or any US state. Our Kentucky hub explains each option, and our US legality overview compares states.
Who regulates gambling in Kentucky?
The Kentucky Horse Racing and Gaming Corporation regulates horse racing, sports wagering and, since HB 904, fantasy contests. The Kentucky Lottery runs the state lottery separately. No Kentucky agency licenses online casinos, so none oversees the offshore sites that advertise to Louisville or Lexington players. We found no KHRGC statement on offshore casinos. See our player protections comparison for what a regulator adds.
When did sports betting start in Kentucky?
Retail sports betting started on September 7, 2023, and mobile betting launched on September 28, 2023, under House Bill 551, according to the KHRGC. Licenses run through the state's nine licensed racing facilities, each allowed up to three mobile apps, for a maximum of 27. The number actually licensed is not published. Our Kentucky sports betting page and the national sports betting laws guide go further.
What does Kentucky HB 904 do?
HB 904 became law in 2026 after the General Assembly overrode the governor's veto. It creates a KHRGC licensing system for fantasy contests, open to players 18 or older who are physically in Kentucky. It also defines prediction markets and event contracts, and requires online gaming operators to block accounts on the child-support arrearage registry. Our daily fantasy sports laws and prediction markets pages put it in context.
What is the gambling age in Kentucky?
It depends on the activity, and not every age is confirmed in official sources. Fantasy contests are 18+ under HB 904. The sports betting age under HB 551 and the lottery age were not confirmed on the official pages researchers read, so check the operator's terms. Kentucky has no commercial casinos. Offers on our site are for 21+ (18+ where allowed). Compare ages in our gambling age by state table.
What do Kentucky gambling laws say about sweepstakes casinos?
Kentucky gambling laws include no sweepstakes casino ban, based on a third-party tracker checked in October 2026. That differs from neighbors such as Tennessee and Indiana, which banned dual-currency sweepstakes in 2026. Sweepstakes sites say they are not gambling because you can play without buying, but they are not licensed real-money casinos. Our Kentucky sweepstakes casinos page and sweepstakes bans tracker explain more.
Can I get in trouble for playing at offshore casinos in Kentucky?
We can't tell you that you will or won't face action. Kentucky has not licensed online casinos, and a state penalty statute for online play was not confirmed in our research. Federal laws such as the UIGEA target operators and payment processing rather than players' bets. Read the Kentucky statutes or ask a lawyer for certainty. Our answer to whether you can get in trouble covers the general picture.
Where can Kentucky residents get help with gambling?
The Kentucky Council on Problem Gambling at kycpg.org offers state help, and the KHRGC lists kyproblemgamblingassistance@ky.gov. The National Problem Gambling Helpline is 1-800-MY-RESET (1-800-697-3738), by call or text, free and open 24/7, with chat through NCPG. Gamblers Anonymous meetings, Gamban blocking software and casino self-exclusion all help too. Our responsible gambling section and self-exclusion guide explain the steps.
Does Kentucky have any casinos?
Kentucky has no commercial casinos in the American Gaming Association's count, and no tribal casinos were recorded in the sources behind this page. Its gambling market is built around horse racing instead: the nine licensed racing facilities hold the sports wagering licenses under HB 551, and the Kentucky Lottery sells tickets in stores and some games online. So players in Louisville and Lexington have no state-licensed slot floor at home. Our Kentucky online casinos hub covers the options, and the tribal gaming page explains how tribal casinos work in other states.
Is Bitcoin gambling legal in Kentucky?
Paying with Bitcoin doesn't change Kentucky gambling laws: online casino games aren't authorized whether you use cards or crypto. No Kentucky law aimed specifically at crypto gambling is on record. Federal UIGEA defines unlawful internet gambling by the law of the state where the bet is made and targets payment processing, not the player's bet. Crypto adds its own risks, since transfers generally can't be reversed. Read our Kentucky crypto casinos page for the payment side and are crypto casinos legal for the national picture.
What is Kentucky's lawsuit against Kalshi about?
Kentucky's Attorney General sued Kalshi and others in Franklin Circuit Court, in a complaint dated June 17, 2026, over event contracts, the trading products prediction markets offer on real-world outcomes. The full case details were not available to review for this page. The suit came in the same year HB 904 added legal definitions for prediction markets and event contracts. It doesn't involve online casinos. Watch the case if you use prediction apps in Kentucky. Our prediction markets page follows the federal bills, and Kentucky sports betting covers the licensed alternative.
Does Kentucky tax gambling winnings?
Federal tax applies to all gambling winnings, and Kentucky state income tax questions belong with the Kentucky Department of Revenue, since state treatment isn't covered here. For payments made in 2026, a W-2G is filed for slot winnings of $2,000 or more, and for sports or other wagering when a win reaches $2,000 and is at least 300 times the stake. From tax year 2026, the loss deduction is reported to be capped at 90% of losses; check IRS guidance. See our W-2G form page and the gambling loss deduction explainer.
Will Kentucky legalize online casinos?
No Kentucky bill to legalize online casinos was recorded in the sources behind this page, so there is no timeline to report. Seven states license real-money online casinos, and Maine legalized tribal-run online casinos in January 2026 under LD 1164, though nothing had launched by October 2026 and a lawsuit is pending. Kentucky's recent moves, HB 904 and the Kalshi suit, have tightened rules on online wagering rather than widened them. Track the list on our states with legal online casinos page and the which states allow online casinos answer.
Can I play casino-style games on the Kentucky Lottery online?
Some games are sold online by the Kentucky Lottery, according to a third-party source that dates online sales to roughly 2019, and those games are the only state-run option for casino-style instant play on a phone in Kentucky. They are lottery products under the state lottery, not online slots licensed by the KHRGC. Ages and game lists weren't confirmed in official sources, so check the Kentucky Lottery's own site. Offshore slot sites are a different, unlicensed product. Our state lotteries online guide compares states, and Kentucky online slots covers the offshore side.
