Massachusetts gambling laws at a glance

Massachusetts takes a split approach. It licenses in-person casino gaming and online sports wagering through the Massachusetts Gaming Commission, runs a state lottery, and draws a hard line at online casino games. Anyone in Boston, Worcester or Springfield can legally bet on sports from a phone through a licensed app, but no app or website may legally offer slots or blackjack for real money.

Are online casinos legal under Massachusetts gambling laws?

No. Massachusetts is not one of the seven states that license online casinos, and the state's Attorney General has said so directly. In an October 3, 2024 cease-and-desist letter to Bovada's operator (opens in a new tab), the office stated that offering online casino games without a Commission license violates state gaming laws.

That letter, sent by Attorney General Campbell's office to Harp Media B.V. (also referred to as Hove Media), demanded refunds to Massachusetts customers. It also said the operator's claims to be USA-based broke Chapter 93A, the state's consumer protection law. The office followed with letters to BetOnline.ag and Sportsbetting.ag (opens in a new tab) on June 25, 2025.

The releases do not cite the specific gaming-law sections or penalties involved. They do show that state enforcement in Massachusetts has so far targeted operators, through letters and consumer-protection claims, rather than individual players. Our real money casinos in Massachusetts page explains the practical side for anyone weighing an offshore site.

The Massachusetts Gaming Commission and what it regulates

As the state's gambling regulator, the Massachusetts Gaming Commission (MGC) licenses and oversees the three commercial casinos and the online and retail sports wagering market. It does not license online casinos, because state law provides no such license.

The Commission has launched an official sports betting Seal of Approval (opens in a new tab) so bettors can tell licensed apps from illegal ones. In that announcement, it warns that offshore operators are not licensed by any state and may refuse to pay winning bets. The warning applies just as well to offshore casino sites. Our guide to state regulators compares the MGC with gaming boards elsewhere.

Massachusetts sports betting law

Online sports betting is legal and licensed. The Commission lists seven online operators: Bally Bet, BetMGM, Caesars Sportsbook, DraftKings, Fanatics, FanDuel and Penn/ESPN Bet. A third-party Inquirer report from October 2022 said the authorizing law was signed on August 10, 2022, with a launch hoped for in January 2023; the exact launch date is not published in the Commission material we used.

Sports betting became a state choice after the Supreme Court's 2018 decision in Murphy v. NCAA, which struck down the federal ban (PASPA). That ruling covered sports wagering only and did nothing to authorize online casinos. Details on apps, ages and markets are on our Massachusetts sports betting page.

The Massachusetts State Lottery and online sales

The Massachusetts State Lottery is legal and state-run, and lawmakers authorized online sales in 2024. A third-party news report dated April 28, 2026 said the lottery's mobile app was expected to launch that summer, two years after approval, but a live launch is not confirmed in our sources. Check the Lottery's own channels for the current position.

Selling lottery tickets online is a separate legal track from online casinos. A state lottery app selling draw tickets does not mean slots or table games are permitted online. Our guide to state lotteries online shows how other states have handled the same step.

Sweepstakes casinos and daily fantasy in Massachusetts

Massachusetts has not enacted a sweepstakes casino ban. A third-party legislative tracker records that bill H 4431 stalled. That leaves the state behind several neighbors: Connecticut's ban took effect on October 1, 2025, New York's (S5935-A) on December 5, 2025, and Maine's (LD 2007) in July 2026. See sweepstakes casinos in Massachusetts for how the dual-currency model works and the national ban tracker for the full list.

Daily fantasy sports status is not published in the sources we rely on for Massachusetts, so we don't state a position here. Our daily fantasy sports laws page covers the national picture.

Gambling ages in Massachusetts

The minimum age for casino gaming in Massachusetts is 21, according to the American Gaming Association's 2026 state summary. Minimum ages for sports betting and the lottery are not published in the sources we use, so confirm them with the Gaming Commission or the Lottery before you play. Offshore sites set their own age rules, which may be lower than state law; we only show offers for players aged 21 or over (18+ only where allowed).

A national comparison of casino, sports and lottery ages is in our state-by-state age table, linked in the FAQ below.

Federal gambling laws that apply in Massachusetts

Federal law sets the outer frame, while Massachusetts law decides what is allowed inside it. Massachusetts sits in the First Circuit, whose 2021 ruling in New Hampshire Lottery Commission v. Rosen held that the Wire Act covers only bets on sporting events. The table summarizes the main statutes.

How to check whether a gambling site is legal in Massachusetts

  1. Identify the product. Sports betting can be licensed in Massachusetts; online casino games cannot.
  2. For a sportsbook, look for the Commission's Seal of Approval and check the name against the seven licensed operators.
  3. For a casino site, assume it is not licensed by the state, because no license exists. Read the footer for the license it does claim, if any.
  4. Search the Attorney General's news releases for the brand name to see whether it has received a letter.
  5. Read the site's terms on restricted locations, withdrawal caps and dispute rules before you deposit anything.

What Massachusetts law means for offshore casino players

Offshore casinos keep advertising to Massachusetts residents, and the state's position doesn't change that. If you use one, there is no Massachusetts regulator to hear a complaint, no state protection for your balance and no state review of the casino's terms. The Commission's own warning that offshore operators may refuse to pay winning bets sums up the risk.

Other states have acted against some of our partners too. The Michigan Gaming Control Board named Silver Oak and Planet 7 in an April 9, 2025 cease-and-desist release (opens in a new tab), calling the recipients illegal offshore operators. Miami Club and Slot Madness followed on August 14, 2025, and SlotoCash on October 8, 2026.

Gambling taxes and help for Massachusetts residents

Gambling winnings are taxable federal income, wherever you win them. For 2026 payments the IRS reporting threshold for slot, bingo and keno wins is $2,000, and from the 2026 tax year the loss deduction is reportedly capped at 90% of losses; check IRS guidance. State income tax rules are outside the sources used here, so ask a tax professional. Our gambling taxes guide covers the federal side.

The Massachusetts Problem Gambling Helpline (opens in a new tab) answers at 1-800-327-5050, or you can text GAMB to 800327. Nationally, the National Problem Gambling Helpline is 1-800-MY-RESET (1-800-697-3738), with call, text and chat through NCPG's help and treatment page (opens in a new tab). The free-spin game is not published in the sources we checked.

Silver Oak names its operator as Primrose Media Limited and says it is licensed in Anjouan; third-party listings disagree, and no license number is shown. Third parties variously report Planet 7 as Costa Rica-licensed or unlicensed. Read our Silver Oak review, Planet 7 review and the Anjouan license explainer first. Online lottery sales were authorized in 2024 but a launch was not confirmed in our sources. See our Massachusetts online casino hub for the full picture.

Who regulates gambling in Massachusetts?

Gambling in the state is regulated mainly by the Massachusetts Gaming Commission, which oversees casinos and sports betting. It licenses the three commercial casinos and the online and retail sportsbooks, and runs a Seal of Approval so bettors can spot licensed apps. Our state regulators guide compares the Commission with other states' boards.

What is the gambling age in Massachusetts?

The casino gambling age in Massachusetts is 21, according to the American Gaming Association's 2026 state summary. The sources we use do not publish the minimum ages for sports betting or the lottery, so check with the Gaming Commission or the Lottery directly. Has Massachusetts banned sweepstakes casinos?

No, Massachusetts has not enacted a sweepstakes casino ban. A third-party legislative tracker records that bill H 4431 stalled. Neighboring states have moved faster: Connecticut's ban took effect in October 2025, New York's in December 2025 and Maine's in July 2026. Sweepstakes sites still carry legal and practical risks. Our sweepstakes casinos in Massachusetts page explains the model and where it stands.

What happens to offshore casinos that target Massachusetts?

The Attorney General's office has sent cease-and-desist letters to offshore operators. In October 2024 it told Bovada's operator to stop and demanded refunds to Massachusetts customers, citing state gaming law and the Chapter 93A consumer protection law. No, the Wire Act is not what makes online casinos unlawful in Massachusetts; state law does. In the October 3, 2024 letter to Bovada's operator, Harp Media B.V., the office said the site's claims to be USA-based violated Chapter 93A, alongside state gaming law, and it demanded refunds to Massachusetts customers.
